Tessa Herbert will be referred to as Breeder or Seller or by name within contract. _______________________ will be referred to as Co-Owner or by name within contract. The puppy being co-owned will be referred to as Puppy or Dog within contract.
The Breeder guarantees the above described Puppy has been vaccinated and dewormed according to the health record of said Puppy.
The Breeder has done everything possible to assure healthy and sound puppies that can excel at herding livestock, agility, flyball, and other breed appropriate dog sports and activities. The Breeder has begun socializing and introducing the Puppy to different environments, varied species, people of various ages and sexes. The Co-Owner agrees to continue to socialize and introduce the puppy to new environments.
The Puppy comes with a lifetime guarantee against the following genetic diseases: Collie Eye Anomaly, Degenerative Myelopathy, Intestinal Cobalamin Malabsorption (Border Collie Type), Multidrug Resistance 1, Neuronal Ceroid Lipofuscinosis 5, Sensory Neuropathy (Border Collie Type), and Trapped Neutrophil Syndrome.
If the Co-Owner needs advice on any matters regarding the Puppy, it is urged that they contact the Breeder and heed her advice.
The Co-Owner has 30 days starting on the day of pickup to return the Puppy and receive a refund. If he/she no longer wants or can care for said Puppy, Co-Owner is to return the Puppy to the Breeder. The Breeder will refund the amount of $500.00 Canadian once the puppy is in possession of the Breeder.
Co-Owner has placed a non-refundable holding deposit of $500.00 Canadian for a co-owned breeding dog from Tessa Herbert. Puppy is being purchased for $1000.00 Canadian with limited breeding rights. The Breeder will own full breeding rights to this dog, if this dog is bred without written permission from the Breeder, whether accidental or purposeful, a fine of $5,000.00 shall be incurred by the Co-Owner from each litter the Dog has had, payable immediately to Tessa Herbert. The Co-Owner has 30 days from the birth of unlawful offspring to pay for liquidated damages, or return the Dog to the Breeder and all said offspring.
The Breeder will pay for all necessary health testing require for the Dog to be bred. The Co-Owner agrees to either join the Breeder at vet appointments or allow the Breeder to bring the Dog for all the necessary health testing.
The Breeder has the right to visit the Dog four times per year while the Dog is under co-ownership.
The Co-Owner agrees to allow the Breeder to take possession of this Dog for breeding purposes for up to four days at a time or allow the Breeder to visit with their breeding dog/bitch for up to four days. The Breeder may take possession of the Dog up to five times per calendar year for breeding purposes.
The Co-Owner agrees that the Breeder may take possession of this Dog for 2-4 days per month for sports, herding, and titling. The Breeder will be the handler of this Dog for these activities, unless otherwise discussed with the Co-Owner. If the Co-Owner would like to be the handler for sports, herding, and titling, they must pay for their own expenses and be present for all activities to handle the Dog. The Breeder will cover all expenses for the Dog to be entered into training, competitions, and titling.
If this Dog is female, the Breeder will take possession of the Dog one week prior to the delivery date and retain this Dog till the puppies are weaned around 5-7 weeks old. The Co-Owner will be able to visit the Dog daily while the Dog is in possession of the Breeder.
The Breeder may remove the Dog from the possession of the Co-Owner in order to protect the health, welfare, and safety of the Dog. If the Dog does not need to be immediately removed from the Co-Owners possession, the Breeder will give a reasonable amount of time to comply with the Breeders requirements for maintaining the health, welfare, and safety of the Dog before permanently removing the Dog.
The Puppy will be registered under the Breeders name until the Breeder decides to neuter/spay the Dog, after which the Breeder will sign over the registration of the Dog to the Co-Owner. Full ownership of the dog will be awarded to the Co-Owner once the Dog is retired from the breeding program.
The Co-Owner agrees to keep this Puppy as a household pet and provide adequate shelter, fresh water, healthy food, affection, and meet all of the Puppy’s physical and mental needs. The Co-Owner will provide veterinary care upon illness, injury, or disease.
If for any reason within the Dog’s lifetime, the Co-owner cannot or will not keep the Dog any longer, or can no longer take proper care of the Dog, the Breeder will be notified immediately and will have the first choice to either take the dog back or assist the Co-Owner in finding a suitable co-owned home for the Dog. The Dog shall not be sold, transferred, rehomed, or be given to any shelter, individual, retailer, veterinarian, research institution, wholesale establishment, or resale to the public, without the Breeders written consent.
The Co-Owner agrees that neither he/she nor the Co-Owner’s estate/executors may sell this Dog or transfer ownership of this Dog without the Breeders written consent.
The Co-Owner agrees to maintain basic obedience training with this Dog.
The Co-Owner and Breeder both agree to keep each other informed of their current and correct addresses and contact information.
The Co-Owner agrees that if the Dog is found to be allowed to run freely, running at large, creating a public nuisance, or found to be neglected, abused, or allowed to live in poor health or poor conditions, the Breeder has all rights to the repossession of this Dog with no refund to the Co-Owner. The death, injury, or loss of said Dog due to theft, carelessness, recklessness, abuse, neglect, preventable accidents, or any preventable causes will not entitle the Co-Owner to any compensation from the Breeder. The Breeder will thus far end any and all business between Breeder and Co-Owner, unless Breeder sees fit to pursue lawful action.
This Dog comes with a microchip, which the Breeder purchased and had inserted by a veterinarian. The Breeder will remain a contact on said microchip and the Breeder will take the Co-Owner’s information and have it added. The microchip is not to be removed, unless a certified veterinarian deems it unhealthy to remain in the Dog, under which circumstance the Breeder is to be notified no later than two weeks after the removal procedure.
Both Breeder and Co-Owner are in agreement of these terms and will hold true to them. All information is correct and truthful to the best of both parties knowledge. If for any reason or at any time, a clause in this contract is broken, the Breeder reserves full right to legal action and a monetary compensation to the Breeder are to be applied.

The buyer has 30 days starting on the day of pickup to return the Puppy and receive a refund. If he/she no longer wants or can care for said Puppy, Buyer is to return the Puppy to the Breeder. The Breeder will refund the amount of $1000.00 Canadian once the puppy is in possession of the Breeder.
Buyer has placed a non-refundable holding deposit of $500.00 Canadian for a puppy from Tessa Herbert. Puppy is being purchased for $1,500.00 Canadian with limited registration, which prohibits breeding and prohibits registering or selling of any unlawful offspring. The remaining balance of $1000.00 Canadian is to be paid before or upon pick up of the Puppy, unless otherwise discussed. If the Puppy is bred, whether accidental or purposeful, a fine of $5,000.00 shall be incurred by the Buyer from each litter the Dog has had, payable immediately to Tessa Herbert. The Buyer has 30 days from the birth of unlawful offspring to pay for liquidated damages, or return the Dog purchased from Seller and all said offspring. The Puppy is intended to be a pet or companion only, not a breeding dog/bitch. The Buyer agrees that this Puppy is to be spayed or neutered before the age of 25 months. The Buyer will provide the Breeder with proof from the veterinary office within one month of the procedure.
The Buyer certifies that he/she is buying this Dog for him/herself, to keep, nurture, and cherish for the entire lifetime of the Dog. The Buyer is not acting as an agent for another party.
The Buyer agrees to keep this Puppy as a household pet and provide adequate shelter, fresh water, healthy food, affection, and meet all of the Puppy’s physical and mental needs. The Buyer will provide veterinary care upon illness, injury, or disease. The Buyer will contact the Breeder if any genetic illnesses or diseases should occur with the Puppy.
If for any reason within the Dog’s lifetime, the Buyer cannot or will not keep the Dog any longer, or can no longer take proper care of the Dog, the Breeder will be notified immediately and will have the first choice to either take the dog back or assist the Buyer in finding a suitable home for the Dog. The Dog shall not be sold, transferred, rehomed, or be given to any shelter, individual, retailer, veterinarian, research institution, wholesale establishment, or resale to the public, without the Breeders consent.

Both Breeder and Buyer are in agreement of these terms and will hold true to them. All information is correct and truthful to the best of both parties knowledge. If for any reason or at any time, a clause in this contract is broken, the Breeder reserves full right to legal action and a monetary compensation to the Breeder are to be applied.

Buyer agrees to not allow this Dog to be bred till he/she has reached the age of 24 months. The Buyer will not breed this Puppy till he/she has had OFA (Orthopedic Foundation for Animals) certification on hips and elbows, with the results being either good, excellent, or normal.
The Buyer will only breed this Dog with another registered border collie. If the Buyer allows this Dog to be bred by another breed, whether accidental or purposeful, a fine of $5,000.00 shall be incurred by the Buyer from each litter the Dog has had, payable immediately to Tessa Herbert. The Buyer has 30 days from the birth of unlawful offspring to pay for liquidated damages, or return the Dog purchased from Seller and all said offspring.
